The Yukon Court of Appeal has rejected an appeal by a man challenging his sexual assault conviction. Rudra Amin, currently residing in Calgary, was convicted in 2023 of sexually assaulting three women in Whitehorse between 2017 and 2018. The victims reported the incidents in 2020. A jury trial found Amin guilty on four counts of sexual assault.
Following his sentencing, Amin promptly filed an appeal and was subsequently granted bail. In his appeal, Amin sought a reduction of his slightly over two-year sentence by two months to qualify for a conditional sentence order to mitigate potential immigration consequences, as per court records.
In a ruling dated August 6, Justice Susan Griffin dismissed the appeal. Griffin refuted Amin’s assertion that the sentencing judge had committed errors and deemed Amin’s request for a conditional sentence unsuitable. Griffin emphasized that unless Amin could demonstrate a fundamental error impacting the sentence, his plea to truncate the sentence by two months was unwarranted.
“This is merely minor adjustment and falls outside the purview of this court,” stated Griffin in her decision. Amin is slated to serve his slightly over two-year sentence as originally imposed.
